Why Brendan Sorsby has ‘solid case’ to sue NFL over supplemental draft snub

Brendan Sorsby most likely won’t be playing in the NFL in 2026 after the league opted not to hold a supplemental draft where he could be selected. However, there is still a way he could try to force his way in.

Sorsby could sue the league and say that the league is unfairly denying him employment, which would undoubtedly get NFLPA backing. If he won, the league could hold the supplemental draft after all and Sorsby would likely be selected.

NFL insider Albert Breer broke down why Sorsby would have a chance to win his suit against the NFL if he chooses to file one.

“I’m not a lawyer, but I think he has a solid case,” Breer wrote. “The NFL is a trade association. Sorsby is not a member of its union. I’m not sure, legally, if a trade association can deny employment this way—especially given the rules of the supplemental draft, which has for decades been where players who lose their eligibility go, be theirs a drug case (Josh Gordon), an NCAA rules case (Terrelle Pryor) or an academic case (Ahmad Brooks and many others). I’d think they’d have to leave his employability up to their companies (the teams).”

Of course, Sorsby suing the league isn’t a given. He could instead opt to just accept his punishment, which many people have advised him to do, and train until the 2027 draft. He has been through a lot of legal processes already during this entire saga and he may just be sick of it.

There is also no guarantee that Sorsby would win his case if he does sue. The NFL can opt to not hold a supplemental draft at its discretion, and it’s clear that the league is making an example out of him given the severity of his NCAA infractions.

Regardless of when he comes into the NFL, Sorsby will undoubtedly get an opportunity with a team. He is a very talented quarterback with a big arm and intriguing athleticism, which is something that NFL teams covet. When that chance comes is still to be determined.
