Lamar Jackson and Troy Aikman have reportedly settled their trademark dispute over the number 8. The Baltimore Ravens quarterback had previously taken legal action against the Hall of Famer attempting to stop the Dallas Cowboys legend from using the number in his businesses.
Last year, Lamar Jackson, who holds and has filed for several trademarks involving the number 8 with the U.S. Patent and Trademark Office, took issue with Troy Aikman using “EIGHT” on on apparel, bags, beer, beach towels, and energy drinks. Troy Aikman’s company, FL101, has also submitted nine trademark applications for “Eight.”
In a court filing, Jackson claimed that Aikman’s use of the number 8 “could potentially cause confusion for the purchasing public, leading them to mistake whether they are buying products from Jackson or Aikman’s company.”
Shortly after the filing, Troy Aikman joked on X (Twitter), “Hey Lamar – looks like a worthy conversation over a couple cold EIGHT beers! Maybe Steve Young can arbitrate??” Hall of Famer quarterback Steve Young also wore the number 8 throughout his career and Aikman owns the beer company EIGHT.
This week, the Baltimore Sun reports that Jackson has filed a withdrawal of his challenge to Troy Aikman’s use of the number 8. In the new filing, Jackson moved to withdraw his oppositions “with prejudice” to two of Troy Aikman’s pending trademark applications.
While terms of the settlement have not been revealed, Gerben Law notes that “the withdrawal is notable because it states that Aikman did not consent, a sign that the settlement terms likely favored the former Dallas Cowboys quarterback.”
Lamar Jackson filed a similar claim against Dale Earnhardt, Jr. in 2024 over his use of the number 8. That dispute was quickly settled because Earnhardt had already decided to stop using the stylized version of the number 8 that Jackson was against. However, the Baltimore Sun claims Jackson’s case against Earnhardt is “still pending before the USPTO.”
“We got what we wanted, and down the road, I was not gonna argue with Lamar over something that I didn’t plan on using,” Dale Jr. said. “I wasn’t going to spend thousands of dollars with my lawyers to fight for something I didn’t need.”
